UNPRECEDENTED PROVOCATION!

THE APPEALS COURT OF ATHENS ACQUITTED THE DISSEMINATOR OF THE EXTERMINATION OF THE JEWS, THE NAZI KOSTAS PLEVRIS!

Today March 27, 2009 after a procedure of postponements and continuous cessations that lasted approximately one year, the First Five Member Appeals Court of Athens acquitted the nazi K. Plevris! (*)
This is a horrifying decision that blatantly infringes the antiracist law 927/79 and the international conventions ratified by Greece, and above all, it consists a direct shielding and encouragement of the anti-Semitic hate and violence propaganda that strengthens in our country in the last period.

For extracts of the book “Jews the whole Truth” included in the indictment - such as :
- “That’s what the Jews deserve. For it’s the only way they understand: firing squad within 24 hours...”
- “Wake up, the treacherous Jews are digging a pit for the Nations. Wake up and throw them in, for they deserve it...”
- “The civilized world is to blame that tolerates those international pests called Judeans... the time of retaliation has come...”
- “The Jew (in religion) and the human being are contradicting terms, that is the one excludes the other”
- “The criminal behavior of the Jews explains the Nazis’ deeds against them, and more than that, it justifies them”.
- «The history of the humankind will hold Adolf Hitler responsible for the following: He did not rid Europe from the Jews while he could» etc,

it was judged that they do not consist invitation to violence and hate provocation against the Greek Jews.

Also for phrases such as:

- “We despise the Jews for their morality, for their religion, for their deeds, which all prove that they are sub-humans”.
- (Underneath Auschwitz photo): “They rightly preserve the camp (Auschwitz) at a good condition, because nobody knows what might happen in the future”
- “I cannot bear to see the murderers, bandits, rapists, oppressors, pests, corruptors, sappers of the ruffian Jewry, slandering the superior National-Socialists...”
- «The ΖΥKLON B was nothing more than a poisonous gas that was used to clear the concentration camps from insects……all the rest are fairytales of propaganda»
- «The Jewish corpse in the case of Auschwitz was proved absolutely false from the beginning»
- «Get rid of the Jewish propaganda, that deceives you with concentration camps, gas chambers, «ovens» and other fairytales of the pseudo-holocaust...» ,

it was judged that they do not insult the Greek Jews!

In other words, it was judged that no penalty should be imposed on the glorifier of the Third Reich, Hitler, Gobbles, Himmler, of the “superior national socialists”, of the “heroic” SS who claims that «it will not be long until the dawn of the day that the flags of nazism will rise again», and who has written 1,400 pages trying to convince his readers that the “sub-humans Jews” must be exterminated and ousted from all European Countries.

That is, the court acquitted a nazi who produced only writings that consist nothing less than the definition of provocation to racist violence and hate.
This decision is not an isolated fault of a specific court consisted of specific judges, but comes as a capstone of a series of anti-Semitic positions expressed by judges who participated in this judicial procedure from its beginning. The most worrying aspect of this case is that this decision was taken within a certain political environment where parliamentary cadres of the party LAOS (“Popular Orthodox Rally”) defended the nazi in court and out of it. At the same time all the other parliamentary parties headed by the anti-Semitic «left», kept a stand of scandalous, guilty, and lengthy silence, blatantly favoring the defendant and LAOS.
Most characteristic is the silence about the provocative stand of the LAOS MP, Thanassis Plevris, counsel of the defense for the nazi in court, who went so far as to state that anyone has the «democratic right» to call for the extermination of any people even for the re-opening of Auschwitz!

Antinazi Initiative will not stop here: This judgment that consists negative landmark in the democratic course of our country, shame for Greece and for the Greek justice will become known to the Greek people, to Europe and to all democratic countries.

We call the democrats to react to the process of fascistization of our country before it is too late.

* The judgment has as follows: Regarding Article 2 of Law 927/79 punishing dissemination of insulting ideas against a group of people, the nazi was acquitted unanimously (5-0)
Regarding Article 1 of the law punishing provocation to actions that may provoke racist hate and violence he was acquitted with 4 votes in favor and 1 vote against.

THE TRIAL AND CONVICTION OF NAZI K. PLEVRIS IS BEING MUFFLED – THE IMPLICATION OF THE POLITICAL PARTY LA.O.S IS COVERED UP

In the late 2007, after a couple of interruptions and postponements of a trial with international interest, the overt racist and nazi K. Plevris was given a suspended 14 months sentence for his book “Jews, the whole truth”.

This book is a patchwork of nazi propaganda stereotypes, phenomenal in post-war Europe. In his book the nazi writer calls for the extermination of the Jews and passionately praises Hitler, the SS, and the Third Reich, by saying that “its banners will wave again”. At that, he critisizes the nazis for not having fulfilled the task of extermination of the Jews, “although they were in a position to do so”!!! His conviction is founded on the 927/79 law which punishes whomever incites violence against citizens for their race, nation, or religion.

This self-evident condemnation may have given the impression that we live in a rudimentarily democratic country. However, here happen the following alarming incidents:

The court decided to expel counsels of the plaintiffs from the trial, and allowed the nazi and his many defense counsels to attack the witnesses for the prosecution. Whenever the prosecutor and the judges took a stand on the essence of the issue, they spoke mostly in favor of the nazi. Especially one of them, the Public Prosecutor Lazarakos, supported and praised K. Plevris, called his nazi monstrosity “scientific writing”, and attacked the witnesses for the prosecution.
Public opinion has never been informed about the existence of that extremely important trial and that conviction because no TV channel in Greece mentioned them, not even as news. And they not only covered up the nazi writer that way but also continued to invite him to speak in their broadcasts and this time more frequently than before!
This scandalous cover-up and promotion of the nazi from the TV channels would be impossible if even one of the parliamentary parties had uttered a word about this trial during the time given to them in the news broadcasts. On the contrary, they have been whispering to their members and sympathizers that the book praising the nazis is just “some marginal opinions of a marginal guy” and that a conviction against him would be against freedom of expression, that is they practically acted in favor of the nazi’s acquittal, both penally and politically.
Yet, what kind of “margin” is that, when the two most prominent parliamentary representatives of LAOS passionately support this book? The first, A. Georgiadis, declared that this book “is his favorite” (!!!), and promoted it during his TV programme. The other, Th. Plevris, was the nazi’s counsel in court for the trial and also claimed that the book was a “scientific writing”, that the Jewish religion is racist, and that the anti-racist law is anti-democratic. We point here that K. Plevris has been a founding member of LAOS and a candidate of that party in previous parliamentary elections. These facts are not accidental: The leader of LAOS himself, G. Karatzaferis, has previously claimed that the Youth Ministry should be given to the open nazis of “Chrysi Avgi” (Golden Dawn), while in the 2002 local elections he had four nazis of Chrysi Avgi as candidates.

It is obvious that the concealment of the trial and of the conviction of the nazi K. Plevris from the people, as well as the bad atmosphere of the trial is the result of a co-ordinated effort by strong forces within the political system to support the nazi K. Plevris and even more to cover up the LAOS party ties with him. If the nazi’s trial was given the proper publicity, then it is uncertain whether LAOS would have entered the parliament. Besides, the concealment of the conviction boosts the spreading of anti-Semitism, which is the heart of nazism. One may hold his/her own explanation for the reasons the other parliamentary parties cover-up the LAOS party as a pro-nazi party. It is certain, though, that with their silence they assist it to its campaign to appear as the party supposedly representing the poor population while, at the same time, this party slowly but steadily incites among the people suffering from poverty a bloody split, that is the hatred towards immigrants with slogans like: “They deprive us of our jobs and our dignity”. In a country being plunged more and more in economic crisis, such slogans boost the fascists unless they are exposed and deterred soon.

We call upon the democrats to demand the conviction of the nazi at the trail in front of the Court of Appeals, and, even more, to demand that the trial gets a lot of publicity. Unless this happens, even the conviction will be enforced only in papers so that the country is not exposed in front of the international public opinion.

Anti-Nazi Initiative calls upon all democratic people to raise the alarm, come to court and support the democratically-minded witnesses and counsel for the plaintiffs in the trial against the Nazi K Plevris and the newspaper “Eleftheros Kosmos”, which began on 11th September and was adjourned to be reconvened on 3rd December (for more information on the indictment against K. Anti-fascist friends, this is no ordinary trial. It is not a trial in which a small minority group of Nazi racists are denounced by democratically-minded people and punished by the authorities in some European country. It is not just a case of one extoller of the virtues of the Third Reich producing a repulsive 1,400-page-long book calling upon people to rid our country of Jews, and it is not just about the fact that the Jews of this country together with non-Jewish anti-fascists take this person to court for extraordinary and blatant violation of international laws against racial prejudice. It is not about pursuing advocates of racial violence from the fringes of society so distasteful to some theoretical defenders of “freedom of speech”.
No. This trial is a matter of life and death in respect of political democracy in our country. September 11th showed that the country we live in does not practise even rudimentary democracy. September 11th 2007 will go down in the judicial and political history of this country and the whole of Europe as the day when, 60 years after World War II, a court in a European country acted in defence of Nazis and racists, turning against their victims and those who defended them.

At the outset the court made sure it removed the counsel representing the Central Board of Jewish Communities in Greece (KIS) and the Jewish woman Gilbert who is a member of Greek Helsinki Monitor from the proceedings on the “grounds” that the book did not affect the plaintiffs (i.e. the Jews) directly and that it is up to the state to defend anyone who may have been wronged by the book. This having been done, the witnesses for the plaintiffs were left without any support in the face of the unbelievable procedure that followed, which seemed more like a trial in Hitler’s Germany of 1936 than one in a European country in 2007. As there was no one to defend the witnesses for the plaintiffs, the court launched into an infringement of their rights. In other words it constantly interrupted them, commented sarcastically about their being quaint or uneducated, did not concern itself at all with what was stated in the charges and forbade the witnesses to mention the laws against racial discrimination. In this way, it was like the witnesses for the plaintiffs were being accused right from the outset. It was the intention of the court to make the witnesses for the plaintiffs be regarded either as opponents of free speech (this coming from the public prosecutor) or quaint folk making a lot of fuss about a non-existent threat of racial discrimination (this coming from the presiding judge). The protagonist and “shining star” of this onslaught was Public Prosecutor Lazarakos whose rich verbal assault included declaring his stance that Mr Plevris’ Nazi monstrosity was a piece of “scientific writing” and that the author was a “qualified historian and a scientist”. As one of the witnesses for the plaintiffs fervently and vociferously refused to accept this definition of the author, the public prosecutor even reached the point of threatening to have her arrested and put in a cell.
This all took place amid applause, loud laughter and interruptions from the Nazis gathered in the courtroom.

What follows is taken from statements made in court:

- The Public Prosecutor started questioning Anna Stai of Antinazi Initiative and the first witness for the plaintiffs (it lasted an hour and a half). He began: “Let’s start with this question so that we can assess the validity of your testimony. What is your educational background?” The following exchange took place later with Irene Koutelou, the second witness for the plaintiffs who is also from Anti-Nazi Initiative:
Public Prosecutor: “So, you are qualified in law. Very good. Let me ask then what an offence of endangerment is. Never mind now. We might take it up later”.
Judge (sarcastically): “When she takes her examinations”.
Koutelou: “I have already passed my examinations. I am a practising lawyer”.

Nazi writer Plevris must be condemned

Dear Friends,

The nazi Kostas Plevris has been prosecuted according to the Greek anti-discrimination law, and will be on trial on September 5, 2007, before the penal court of Athens, for publishing a book entitled “Jews, the whole truth”. Along with him, the editor and two columnists of the fascist newspaper “Eleftheros Kosmos” (Free World) also go on trial.
The nazi writer propagates genocidal hatred for the Jews, glorifies Hitler, the “Aryan race”, and the “Third Reich” in this book, which has already sold thousands of copies. Hitler is only criticized for the mere reason of not clearing Europe of the Jews. As one can read in Pg. 852: “afterwards, history of humankind will accuse him (Hitler) of having done nothing to rid Europe of the Jews, though he could…”

This prosecution is of great importance because the pro-Hitler and anti-Semitic literature thrives in Greece. It’s only in Greece, among all other European countries, that dozens of pro-Hitler magazines and books pro-Hitler or specifically anti-Semitic – like the “Protocols of the Elders of Zion” that has been a best seller – are being sold in nearly every kiosk and in bookstores even big ones. However, the state and judicial authorities do nothing to deal with this oversupply of hate and nazi propaganda, though the law obliges them to. This prosecution against the most overt nazi was the result of a charge brought by the Greek Jews (Central Board of Jewish Communities in Greece), and of a supporting memorandum submitted by the Antinazi Initiative.

The peculiarity of Greece in comparison with the other European countries – with the exception of the more and more anti-Semitic Russia – is that anti-Semitism here is not a marginal ideology of a minority, but a mainstream ideological current. Dominant political forces within the Greek parties have been hiding their anti-Semitism before the EU, but they have been cultivating it at the base of society for many years now, by using the cliche: the Jews and their illegal fascist state, Israel, dominate the US foreign policy and through that policy they attempt to subjugate the nations.

Quite characteristic of that attitude is the fact that all parliamentary parties in Greece are in favour of the legal status of the overtly nazi party “Golden Dawn” (“Chrysi Avgi”). In fact the Ministry of Internal Affairs and the Ministry of Press invite “Golden Dawn” at the inter-party meetings held at pre-election periods to allocate TV time for the parties participating to the elections! Also, no-one should forget that Greece is the only country of the EU that wholeheartedly stood by the Serbian fascists during the war in Bosnia, and shielded the Greek nazis that took part in the genocidal massacre of Srebrenica leaving them unpunished for their crimes.

This explains Plevris’ impudence to bring a charge against his accusers claiming that they slander him!

The Antinazi Initiative calls upon all European democrats:
-To demand that the nazi K. Plevris, as well as his collaborators, be condemned by the court on 5 September 2007.
-To make this case against K. Plevris widely known in their countries, and to denounce the anti-Semitic phenomenon in Greece.

The Antinazi Initiative denounces the scandalous impunity of the nazis of “Golden Dawn” that continue their murderous activity undisturbed. Recently they attacked to two young people at Monastiraki injuring seriously one of them. This attack happened almost simultaneously with the third in a row postponement of the trial of members of “Golden Dawn” accused for a similar bloody attack that happened in November 2002. The whole political regime that still recognizes legal status to the nazis is responsible for their impunity.

From the beginning of October, the website of the pronazi historian David Irving hosts an “invitation” to the presentation of the Greek edition of his new book “The War between Generals” (David Irving’s famous D-DAY history, as he calls it) at the hall of the Association of Journalists of Athens Daily Newspapers (ESIEA). The event at which Irving is also going to give speech on the position of Greece during Second World War is organized by the publishing house “IOLKOS” on October 25, just three days before October 28, day of national celebration for the Greek antifascist struggle in 1940-1941. The news was also presented at the nazi portal “Meandros”.
Irving has already been condemned in Britain after a trial that lasted 5 years, for Holocaust denial, racism and antisemitism while his entrance is forbidden to several countries such as France, Germany and Canada.
It would be a great provocation for democracy in Greece and Europe, if that man, a symbol for nazis worldwide, succeeded, to come to Greece, state member of EU, to present his well known and widely denounced, anti-Semitic and pronazi arguments, and even more to do this in the hall of Greek journalists.
As soon as the organization of the event became known, the Antinazi Initiative, protested to ESIEA verbally and in writing, asking not to give Irving any space to present his book. The Board of ESIEA decided finally not to accept Irving, and characterized him unwanted as propagator of historic revisionism, Holocaust denial, an anti-Semite and racist, while the whole matter had great publicity at the press. The Central Council of Israelites of Greece also protested against Irving’s visit.
Nevertheless, Irving has not cancelled his trip and now states that he is still going to present his book in Greece in some other place “to be announced soon”. In fact this will not be the first time for him. Two years ago, in April 2003, Irving had given a speech at the hall of war museum given to him by the Greek army officers who attended the event together with a member of the Parliament, and, of course, lots of members of the Greek nazis of “Golden Dawn”. All together applauded the presentation of Irving’s book “Hitler’s War” published by “Govostis” in Greek where he attempted to excuse Hitler’s responsibilities for Holocaust.
The Antinazi Initiative has called every state, collective or private organization and every citizen to refuse to give any space in Greece to the apologist for barbarism.

The Antinazi Initiative welcomes the decision of the Association of Journalists of Athens Daily Newspapers not to give its conference hall to the pro-nazi British author David Irving. Irving, the idol of nazis worldwide, has been condemned in Britain for “denial of the Holocaust”, as a “racist” and “anti-Semitist”, while the entrance to many countries has been forbidden to him.
We call upon every state, collective, or private organism and every citizen of our country to give no space to the apologist for barbarism.

NEWSLETTER OF ANTINAZI INITIATIVE FOR THE CANCELLATION OF THE NAZI FEST IN GREECE
(Athens, September 19, 2005)

The notorious euro-fest organized in Greece by the nazis of “Golden Dawn” never happened! The Greek government banned the euro-fest. This ban consists a great antifascist victory for Greece and for Europe. This is also the first time that the Greek nazis faced ban after almost 20 years of unbelievable immunity and non-punishment by the Greek political regime.

The Antinazi Initiative at first put up posters in Athens inviting the government to ban the nazi fest and the political parties to take a stand. Then we addressed an appeal to Greek and European antifascists to sign a protest letter to the prime minister. The response to this appeal was great especially at international level. The Central Jewish Council of Greece, had also requested the ban of the festival ever since the organization of the event became known.
The matter gained publicity day by day and protests were made from the Jewish organizations of abroad like CRIF, Wiesenthal Center, and also from European antiracist organizations and networks. It was made known lately that a representation of OSCE would come to Athens to assure that the government has taken all necessary measures against nazi fest. Furthermore, protests from many sides reached the Ministry of Foreign Affairs.

Under these very strong international pressures the Greek government shifted its initial position that the nazi fest cannot be banned. On September 6, 2005, a few days before the announced dates for the festival (16-18 September), the governmental spokesman stated that the government bans it. Immediately afterwards, the Minister of Public Order stated that the police will take all appropriate measures to prevent it. The outcome was that the nazis could not find any place in Greece to accept their gathering as there were local reactions. In the meantime on September 13, 2005, as a result of their first great political and moral defeat, their leading member Antonis Androutsopoulos, better known as “Periandros”, wanted and curiously not arrested for seven years now, gave himself up to the authorities and was sent to prison to serve a four years sentence.
On September 15, 2005, the “Golden Dawn” announced at its weekly newspaper that on September 17, 2005 (supposedly 2nd day of the festival) an event would take place at its offices, the subject of which would be: “The bans do not intimidate ideologists!”.
On September 16, 2005 there was no sign of the festival in Greece. At the same night the nazis distributed handouts at the center of Athens informing that the next day, September 17, in the afternoon, they would organize a protest gathering in Athens, a few meters far from their offices.
In the morning of September 17, at their newspaper «Eleftheros Kosmos» (Free World), they announced that actually the festival had already taken place in a town of Italy – Latina and that it was cancelled in Greece due to the ban.
At the same day, in the afternoon, around 18.30, not more than 100 nazis gathered at the announced spot. It was obvious that the government, in order to lessen the defeat of “Golden Dawn”, allowed them this gathering outside their offices. Nevertheless such gatherings were always allowed to them by the governments so far, something that was virtually accepted by the whole official political world.

At the same time, near the location of the nazi gathering, two anti-gatherings took place: one was held by the organizations of non – parliamentary left at Omonoia square and the second by groups of anarchists nearer to the offices of “Golden Dawn”.
Strong police forces closed the roads leading to the nazi gathering preventing those who participated to the anti-gatherings to reach it. About one hour later the nazis went back to their offices and the anti-gathering at Omonoia Square dispersed. It was at that moment that a squad of so-called anarchists, for no reason, dropped petrol bombs and stones against policemen, burnt cars and broke store windows, after having first burnt a Greek flag. Unfortunately, for one more time, the nazi gathering was facilitated morally and politically by the violent acts of the so-called anarchists that, as usually, were tolerated by the police and remained unpunished.
ANI believes that any anti-gathering against the nazis in order to be effective and not to contribute to the vilification of antifascism in front of people, should in the first place denounce those systematic provocateurs, whose activity the whole political regime virtually tolerates and covers.

ANI welcomes the wide international solidarity and thanks all the antifascists that responded to its action alert. A good start has already been made. The next objective is to have “Golden Dawn”, a cancerous nazi tumour within European Union, outlawed.

The ban of the nazi fest was a political blow of tremendous significance for the nazi and their protectors. The ban was mainly a result of the international outcry and pressure that forced the government to shift from its initial position. However, this government, in order to lessen the nazis defeat, allowed them to hold a gathering, as every government has allowed them so far, and the whole official political world has virtually accepted.
The nazi gathering was morally and politically facilitated once more by a squad of so-called anarchists, who set a Greek flag on fire and vandalized at the center of Athens with the shielding of the police.
Any anti-gathering against the nazis in order to be effective and not to contribute to the vilification of antifascism also, should in the first place denounce those systematic provocateurs, whose activity the whole political regime virtually tolerates and covers.

PRESS RELEASE OF ANTINAZI INITIATIVE
REGARDING THE TURNING IN OF NEO-NAZI ANDROUTSOPOULOS
(September 15, 2005)

The neo-nazi Antonis Androutsopoulos, leading member of “Golden Dawn”, better known as “Periandros”, turned himself in on September 13, 2005. Androutsopoulos is wanted since June 1998, for leading a team of ten thugs that brutally attacked a student, Dimitris Kousouris who was badly injured, and other two people. At the time, the police was accused for unwillingness to arrest the perpetrators although the incident happened near the courtbuildings of Athens that are guarded by police forces.

In April 2004, Androutsopoulos was convicted in absentia to 4 years of imprisonment for "organising a criminal gang, illegal possession and use of weapons". Also he was charged with premeditated attempted murder. His trial for this is still pending.

It is also highly questionable according to journalistic research that Androutsopoulos ever left Greece in order to flee to Venezuela (as he claims now), taking into consideration testimonies of persons that have seen him in Peloponnisos and Athens.

The fact that Androutsopoulos remained free for seven years is related to the general status of immunity that is scandalously granted to the nazis of “Golden Dawn” by the whole political regime for decades now.

Irrespective of any expediency that lies behind Androutsopoulos turning in-arrest, this is an important democratic victory that, as we believe, is related to the weakening of the political position of nazis following the international outcry against their festival and the domestic reactions.

The Antinazi Initiative calls the democrats to constant alert until:
The governmental declaration for ban of the nazi fest is implemented.
The government complies with CERD (Convention for the Elimination of Racist Discriminations) and outlaws nazi gangs.

Following international and domestic protests, the government was forced to declare that the pan-european nazi meeting in Greece is banned. Nevertheless, the democrats should be alert until the actual implementation of this declaration, as still the great scandal for all Europe remains, namely the legal function in our country of "Golden Dawn", an overt nazi organization.

The Antinazi Initiative calls upon the democrats to stoutly oppose the devious argument that the nazi meeting in Greece should be allowed so as not to violate the freedom to assemble and the freedom of expression.
These kinds of freedom are not recognized to the nazi in any European country. In the same way that the pedophiles, for instance, are not allowed to gather and propagandize their “opinion”, even more so the overt Hitler fans don’t have the right to assemble in public and support their “opinions”, according to the law, the constitution and the international conventions. Because propagandizing nazism AUTOMATICALLY means incitement to racial violence and to anti-Jewish genocide. It is indicative that the nazi themselves call their meeting a “hate-wave festival”. It is quite alarming for the democracy in our country the fact that the Greek prime minister refuses to ban the meeting so far and that the leader of the opposition does not demand its ban.

We are informed that the nazi march, which was about to take place on August 20 in Wusientel –Germany– towards the grave of the criminal Rudolf Hess, was finally banned by the German authorities.

60 years since Hitler's genocidal war, nazis from all over Europe are about to gather in the Peloponnese in September (16-18/9). The organizer of this meeting is the nazi organization "Golden Dawn". The government and the parliamentary parties bear the responsibility for that huge provocation against the democratic people of our country. Opposite to what happens everywhere in democratic Europe, they've been allowing and tolerating the existence and action of an overt nazi organization, such as "Golden Dawn", for decades. It is because of this tolerance and shielding that "Golden Dawn", being unpunished so far, has taken part in the genocidal army of the criminal Karadzic in Bosnia. Within the bounds of this reasoning of tolerance, the governmental spokesman, Th. Rousopoulos, referring to the nazi gathering, stated: "there is no evidence that any formal demand to hold the neo-nazi meeting has been submitted". This is actually shielding of the nazi gathering because in the democratic countries the nazis HAVE NO RIGHT to organize meetings, either they ask permission or not. The spokesman of the police, Oikonomou, set it even more clearly: "we cannot forbid a peaceful meeting, where the participants don't carry guns" (from the Greek newspaper "NEA", 6.7.05).
